Terms of Service
These Terms of Service (“Terms”) are a binding agreement between you and [OPERATOR LEGAL NAME] (“we,” “us,” or “DigiWallGlobe”), the operator of the DigiWallGlobe website (digiwallglobe.com) and the Capsealo mobile application (together, the “Services”). By creating an account, subscribing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Who can use the Services
You must be at least 13 years old (or the minimum digital-consent age in your country, whichever is higher) to use the Services. If you are under 18, you confirm a parent or legal guardian has reviewed and agreed to these Terms on your behalf. You agree to provide accurate account information and to keep it up to date.
2. Accounts & sign-in
Accounts are created using Google Sign-In. You are responsible for activity that happens under your account and for keeping your Google credentials secure. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe create risk for the Services or other users.
3. What the Services do
DigiWallGlobe is a digital “Wall of Names” and world map. Capsealo lets you create time capsules — collections of text, photos, voice notes, and video that can be kept private or revealed publicly. Subscribers may claim a profile slot on the DigiWallGlobe globe, and certain public capsule content may be displayed on the Wall and map.
4. Subscriptions, purchases & promo codes
- Billing. Paid subscriptions and capsule purchases are processed through Google Play Billing (Android) and are subject to Google’s payment terms. Prices are shown before purchase.
- Renewals. Subscriptions renew automatically unless cancelled before the renewal date through your Google Play account. You manage and cancel subscriptions in Google Play.
- Refunds. Refunds are handled according to Google Play’s refund policy and any mandatory consumer-protection rights you have under [GOVERNING-LAW COUNTRY] law.
- Promotional codes. We may issue promo or discount codes. Codes are non-transferable, have no cash value, may be limited to one redemption per user, and may be withdrawn or expire at any time. Codes are intended only for the recipients we provide them to; sharing or publishing private codes may void them.
5. Your content & the license you give us
You keep ownership of the text, images, audio, and video you upload (“Your Content”). To operate the Services, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt (e.g. generate thumbnails, transcode video, crop clips you ask us to crop), and display Your Content solely to provide and promote the Services. For content you mark public or reveal, that display may include the DigiWallGlobe Wall, map, and profile cards. This license ends when you delete the content or your account, except for copies retained for a limited period in backups or where the law requires retention.
6. Content rules
You agree not to upload or share content that:
- is illegal, infringes someone else’s intellectual property, privacy, or other rights;
- is sexual content involving minors, or sexual content shared without consent;
- harasses, threatens, defames, or incites violence or hatred;
- contains malware, spam, or attempts to deceive or defraud;
- impersonates another person or misrepresents your identity or affiliation.
We may remove content or restrict accounts that breach these rules. We are not obligated to monitor content but may do so to keep the Services safe and lawful.
7. Acceptable use
Do not attempt to break, overload, reverse-engineer, scrape at scale, or gain unauthorized access to the Services or other users’ data. Do not bypass security, rate limits, or access controls. Automated access is only allowed through interfaces we provide for that purpose.
8. Intellectual property
The Services — including software, design, logos, and the DigiWallGlobe and Capsealo names — are owned by us or our licensors and are protected by law. We grant you a limited, personal, non-transferable license to use the Services as intended. These Terms do not transfer any of our intellectual-property rights to you.
9. Third-party services
The Services rely on third parties including Google (sign-in, Play Billing, push), Cloudflare (storage and delivery), and infrastructure/analytics providers. Your use of those features may also be subject to their terms. We are not responsible for third-party services we do not control.
10. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We do not guarantee that a capsule will be revealed at an exact moment, that content will never be lost, or that the Services will be uninterrupted or error-free. You are responsible for keeping your own copies of important content.
11. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or goodwill. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the 12 months before the claim, or [CURRENCY] [AMOUNT, e.g. ₹5,000]. Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Termination
You may stop using the Services and delete your account at any time. We may suspend or end your access if you breach these Terms or to comply with the law. Sections that by their nature should survive termination (e.g. content license for residual backups, disclaimers, limitation of liability, governing law) will survive.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, notify you in-app or by email. Continuing to use the Services after changes take effect means you accept the updated Terms.
14. Governing law & disputes
These Terms are governed by the laws of [GOVERNING-LAW COUNTRY/STATE, e.g. India], without regard to conflict-of-law rules. The courts located in [CITY, e.g. Bengaluru, India] will have exclusive jurisdiction, except where mandatory local consumer law gives you the right to bring a claim elsewhere.
